By visiting this website, booking a consultation, or engaging Rise And Thrive LLC. ("Rise And Thrive AI," "we," "us," or "our") for services, you ("Client," "you") agree to these Terms of Service ("Terms"). If you do not agree, please do not use our website or services.
Rise And Thrive AI designs, builds, and maintains AI-powered voice and SMS agents ("AI Employees") for appointment-driven businesses, including but not limited to:
Services are customized to each client's workflow and are delivered via third-party platforms, including telephony, voice AI, and calendar/scheduling providers.
Our services are intended for businesses and individuals who are at least 18 years old and have the authority to enter into an agreement on behalf of their business.
Engagement generally follows these steps: (1) a free discovery call, (2) the client places an order to move forward, (3) we build a custom AI Employee around the client's real workflow, (4) we launch by connecting it to the client's calendar and phone number, and (5) we provide ongoing monitoring and refinement. Timelines vary based on complexity and third-party platform availability.
As a client, you agree to:
Our AI Employees are built to a high standard, but AI-driven voice and text systems may occasionally misunderstand requests, mishandle edge cases, or behave unexpectedly. We do not guarantee any specific number of booked appointments, conversion rate, or business outcome. Services are provided on an "as is" and "as available" basis. We will make commercially reasonable efforts to monitor and refine performance as part of ongoing care.
Our services depend on third-party platforms (including Twilio, Vapi, Google Calendar, and Calendly) that we do not own or control. We are not responsible for outages, price changes, policy changes, or service interruptions caused by these third parties, though we will make reasonable efforts to minimize disruption and migrate services if needed.
Rise And Thrive LLC. retains ownership of its underlying methodology, workflows, prompt designs, and automation templates. Custom configurations built for a specific client's business remain licensed for that client's use for as long as the service agreement is active. Upon termination, access to the live AI Employee configuration may be discontinued unless otherwise agreed.
Each party agrees to keep confidential any non-public business information shared during the engagement and to use it solely for the purpose of delivering or receiving the services.
Services continue on a month-to-month basis following setup, unless otherwise agreed. Either party may terminate the ongoing monthly service with written notice as specified in your service agreement. We reserve the right to suspend or terminate services for non-payment, misuse, or violation of these Terms.
To the maximum extent permitted by law, Rise And Thrive LLC. shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities, arising from your use of our services. Our total liability for any claim shall not exceed the fees paid by you to us in the three (3) months preceding the claim.
You agree to indemnify and hold Rise And Thrive LLC. harmless from any claims, damages, or expenses arising from your breach of these Terms, your violation of applicable law (including consent/recording laws related to your End Customers), or misuse of the services.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles, unless otherwise required by applicable law.
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
